Depending on how the Court rules, a Foreclosure Sale will be set between 45 to 120 days. If during this time, a homeowner is not attempting either a loan modification or selling their property via short sale, it will be highly unlikely that the Court will cancel the Foreclosure Sale. If a Foreclosure Sale is not cancelled, the homeowner will eventually lose their property and will not be entitled to the benefits of a loan modification and/or a short sale.
